Terms of service
These Terms of Service (“Agreement”) constitute a legally binding agreement between you (“Customer,” “User,” or “You”) and FlashTronics (“Company,” “We,” “Us,” or “Our”), a technology retailer and service provider located in Miami, Florida. By accessing our website (www.flashtronics.us), purchasing products, or utilizing our repair and related services, you acknowledge and agree to the following Terms of Service. If you do not agree, you must refrain from using our website or services.
1. Scope of Agreement
This Agreement governs the sale of products, the provision of repair services, and your use of our website. It applies to all transactions made with FlashTronics, whether in-store, online, or through third-party platforms.
2. Eligibility
By purchasing products or requesting services, you represent and warrant that you are at least eighteen (18) years of age or have the consent of a legal guardian. You further represent that all information provided to FlashTronics is truthful and accurate.
3. Product Sales
3.1 Availability – All products are subject to availability. FlashTronics reserves the right to modify, discontinue, or substitute products without prior notice.
3.2 Pricing Errors – While we strive for accuracy, typographical and pricing errors may occur. FlashTronics reserves the right to cancel or adjust orders containing errors.
3.3 Finality of Sales – Unless otherwise specified, all sales are final and non-cancellable, subject to our Refunds & Returns policy.
4. Payment Terms
4.1 Payment Requirement – All products and services must be paid in full prior to delivery or commencement of work.
4.2 Third-Party Financing – Financing options may be available through third-party providers (e.g., Acima, Progressive Leasing, Affirm). The terms of such financing are governed exclusively by the financing company and not FlashTronics.
4.3 Deposits – Deposits for repairs, custom orders, or special requests are strictly non-refundable.
5. Warranties
5.1 Manufacturer Warranty Only – FlashTronics does not provide warranties on products sold. Any warranty claims must be made directly to the manufacturer, subject to their terms and conditions.
5.2 Exclusions – Warranties (manufacturer or otherwise) do not cover: misuse, water or liquid damage, physical damage, unauthorized repairs, use of non-original parts, corrosion, normal wear and tear, vandalism, or operation outside of the manufacturer’s manual.
5.3 Disclaimer – To the maximum extent permitted by law, FlashTronics disclaims all implied warranties, including merchantability and fitness for a particular purpose.
6. Refunds and Returns
6.1 Restocking Fee – All authorized refunds are subject to a twenty-five percent (25%) restocking fee.
6.2 Non-Returnable Items – No returns are accepted for opened electronics, used products, or repair parts.
6.3 Approval Requirement – Refunds must be expressly authorized by FlashTronics management in writing.
7. Repair and Service Terms
7.1 Pickup Policy – Customers must retrieve their devices within ten (10) days of repair completion. Devices not collected within this period may be sold to recover costs.
7.2 Repair Warranty – Repairs are warranted for seven (7) calendar days with the original receipt only. No warranty is provided for liquid damage.
7.3 Irrevocability – Once a repair has commenced or a part has been ordered, the order cannot be cancelled.
7.4 Inspection – Customers are required to inspect their devices upon pickup. FlashTronics shall not be liable for any claims after delivery.
7.5 Scope of Repairs – Only repairs expressly listed on the customer’s receipt will be performed.
7.6 Data and Security – FlashTronics is not responsible for data loss, software configurations, accounts, passwords, or undeclared accessories. Customers must remove all iCloud, Google, or carrier locks prior to service.
8. Additional Conditions
8.1 Repair Timeframes – All time estimates for repairs are approximate and subject to parts availability and supplier conditions.
8.2 Parts Used – Repairs may be completed using OEM, original, or aftermarket parts, depending on availability. Customer consent is implied upon acceptance of service.
8.3 Risk of Loss – FlashTronics is not responsible for theft, fire, natural disasters, or external damages occurring while a device is stored at our facility.
8.4 Ownership Representation – Customers certify ownership of devices submitted for service. Any falsified information may be reported to law enforcement as fraud or theft.
9. Limitation of Liability
To the fullest extent permitted under Florida law, FlashTronics shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption. The maximum liability of FlashTronics, whether arising in contract, tort, or otherwise, shall not exceed the total amount paid by the customer for the product or service giving rise to the claim.
10. Indemnification
Customer agrees to indemnify, defend, and hold harmless FlashTronics, its officers, employees, and affiliates from any and all claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from (a) Customer’s breach of this Agreement, (b) misuse of FlashTronics products or services, or (c) violation of applicable law.
11. Intellectual Property
All content, logos, graphics, and designs appearing on FlashTronics.us are the property of FlashTronics and are protected under copyright and trademark law. Unauthorized reproduction, distribution, or modification is prohibited.
12. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the State of Florida. Any disputes arising under or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida. By using our services, you consent to personal jurisdiction in these courts.
13. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
This Agreement constitutes the entire understanding between Customer and FlashTronics with respect to the subject matter hereof and supersedes all prior discussions, agreements, or understandings, whether written or oral.
